The Governor's Commission on the Death Penalty had recommended in 1993 that further inquiry be made into the causes of racial disparities in the administration of the death penalty in Maryland. For this purpose, in July 1996, the Governor formed the Governor's Task Force on the Fair Imposition of Capital Punishment in Maryland (Executive Order 01.01.1996.16).

The charge of the Task Force was to determine the causes of racial disparities in the administration of the death penalty in Maryland.

The Task Force submitted its final report to the Governor in December 1996.
